Stalking

This consultation paper on stalking published in 1998 by the Privacy Sub-committee of the commission recommended that a new offence of harassment be created. Any person who pursues a course of conduct which amounts to harassment of another would be guilty of the offence.
The sub-committee recommended that a court should be able to make an order restraining a convicted stalker from harassing another, as there are no procedures at present under which the criminal courts can provide protection for victims who might be harmed by convicted criminals in the future. The consultation paper also proposed that liability in tort should be imposed on a person who pursues a course of conduct which constitutes the offence of harassment. The victim would then be able to seek an injunction restraining the stalker.
